How to File a Complaint
North Dakota Administrative Code (NDAC) 70-02-01-16 (1-4) states that the complaint to be investigated must include the full name and address of the person/s making the complaint (complainant/s), the full name and address of the North Dakota real estate licensee/s against whom the complaint is made (the respondent/s), and other information as described in NDAC 70-02-01-16 (1), which is linked, below.
All complaints to be invesitgated by the Commission must be verified and in writing on forms furnished by the Commission. The complaint shall be verified by the signature and seal of a Notary Public. Complainant/s must offer a clear and concise statement of facts of the alleged violation.
The Commission's jurisdiction is over the real estate licensee or licensees involved in the complaint. The Commission may not force a licensee to specifically perform under the terms of a contract, nor may it recover damages. The complainant must file a civil action in court in order to seek specific performance or monetary damages.
The Commission only licenses real estate brokers, broker associates, salespersons, and firms. North Dakota real estate license law does not include property managers, property management companies, or other occupations that may be related to real estate. The Commission is not authorized by law to investigate actions taken by individuals who are not licensed by the Commission as brokers, broker associates, or salespersons.
The Commission is not authorized by law nor will it consider or conduct hearings involving disputes over fees or commissions between licensees (NDAC 70-02-01-17).
The Commission will forward a copy of complete and verified complaints to be investigated to licensee/s who must, within 20 calendar days from receipt of the complaint, file their answer on forms furnished by the Commission. This answer must be in written affidavit form, verified with the signaure and seal of a Notary Public, and contain a factual response to all allegations in the complaint.
