How to File a Complaint

All complaints to be investigated by the North Dakota Real Estate Commission are required to be in writing and filed on forms furnished by the Commission. The person/s registering the complaint must offer a clear and concise statement of facts constituting the alleged violation.

A copy of the complaint will be forwarded to the licensee who must, within 20 days from receipt of the complaint, file his or her answer on forms furnished by the Commission. This answer must be in written affidavit form, properly certified and contain a factual response to all allegations set out in the complaint.

The Commission's jurisdiction is over the licensee or licensees involved in the complaint. The Commission may not force a licensee to specifically perform under the terms of a contract, nor may it recover damages. The Complainant must file a civil action in order to seek specific performance or monetary damages.
